The subcontractor must be aware that he is only entitled to an additional period or cost if he meets the essential requirements of the contract notice. In addition, the subcontract provides for a suspension period which requires that, under the subcontract, the parties are obliged to postpone by 112 days, under the subcontract, a request for any ATM procedure (and the ATM is an ad hoc procedure, unlike the ATM generally preferred by the Red Book), under the subcontract, in order to give the contractor time to settle the dispute under the main contract. Therefore, this suspension period “quantifies” the simple “best effort” obligation contained in other standard forms obliging the contractor to pursue subcontracting requests arising from the main contract.
